EU Regulations in Austria

Austria implements EU regulations through national legislation. As an EU member state, all EU regulations (such as GDPR, AI Act) are directly applicable, while directives (such as NIS2) must be transposed into national law.

Key National Legislation

  • DSG (Data Protection Act): Supplements the GDPR with national provisions
  • NISG 2024: Transposition of the NIS2 Directive (in preparation)
  • TKG 2021: Telecommunications Act relating to digital infrastructure

Supervisory Authorities

  • Data Protection Authority (DSB): Responsible for GDPR and DSG
  • BMI/BKA: Responsible for NIS implementation
